Terms of service.

What you agree to when you use the Botardo website, console or API.

Acceptance

By accessing or using the Botardo website, console, or API (collectively the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Service on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.

If you do not agree with any part of these Terms, you must stop using the Service immediately.

The service

Botardo scores every session on your website for bot risk. Your website asks the snippet for a token, and your server trades that token through our verify API for a decision (allow or block) and a bot risk from 0 to 100. When we can't tell whether a session is a person, we challenge the visitor in the browser before a token is issued. Form protection takes care of the token and the challenge for your forms.

Tokens can be verified once and expire two minutes after they're issued. A session covers one browser tab on your website for up to three hours.

We never block a request ourselves. A decision from verify is advice, and what you do with it is up to you. We don't explain individual decisions or scores, to you or anyone else, because explanations help people build bots that get past them.

We may modify, suspend, or discontinue any part of the Service with reasonable advance notice where practical. We aim for high availability but do not guarantee uninterrupted access. Scheduled maintenance will be announced in advance where possible.

Accounts

You must provide accurate information when creating an account. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. Notify us immediately at [email protected] if you suspect unauthorised access.

Each website gets a public site key, which goes in your pages, and a private site key, which your server uses to verify tokens. Keep the private key secret. Anyone who has it can verify tokens as you.

Accounts may not be shared or transferred without our prior written consent.

Your website

You are the controller of the personal data the snippet processes on your website, and we process it on your behalf as described in the Privacy Policy. You agree to:

  • tell your visitors in your own privacy notice that you use Botardo for bot detection;
  • get any consent your local law requires for reading information from your visitors' devices;
  • register only website origins you control;
  • never send form data, typed text or other content through custom events, token requests or any other part of the Service. We never read form data ourselves and you must not send it to us. If we find any, we may delete it.

Acceptable use

You may use the Service only for lawful purposes and in accordance with these Terms. You must not:

  • Use the Service to engage in illegal activity or to process data you have no right to process.
  • Attempt to probe, scan, or test the vulnerability of the Service or bypass any security measures.
  • Send fabricated events or tokens, or try to influence the scores of sessions that aren't yours.
  • Use the Service, its scores or its challenges to build or test tools for getting past bot detection.
  • Reverse-engineer, decompile, or extract source code from any part of the Service.
  • Resell or sublicense access to the Service without our written consent.
  • Transmit malicious code or interfere with the integrity or performance of the Service.
  • Scrape, index, or harvest data from the console or API beyond normal programmatic use for your own websites.

We reserve the right to suspend or terminate accounts that violate these rules without prior notice.

Payment

We bill by decision. A decision is one verify request from your server for a valid token we issued to your website, whatever the decision returned. Each token is billed once. We do not bill page views, tokens that are never verified, or verify requests for a missing, expired, invalid or already used token.

  • Standard: 10,000 decisions a month at no charge.
  • Pro: $199 a month, billed in advance. It includes the same 10,000 decisions at no charge, plus 500,000 decisions a month.
  • Beyond what your plan includes: $5 for every additional 10,000 decisions, billed monthly in arrears.

Annual plans are priced by agreement. All fees are exclusive of taxes. You are responsible for any applicable sales tax, VAT, or similar levy. Payments are processed by Stripe; we do not store card data.

Subscriptions renew automatically each month unless cancelled before the renewal date. We do not offer refunds for partial billing periods already consumed. We'll email you at least 30 days before a price change affects you.

Intellectual property

The Service, including all software, algorithms, scoring models, documentation, and trademarks, is owned by Botardo AG and protected by applicable intellectual property law. These Terms grant you a limited, non-exclusive, non-transferable licence to use the Service for your own websites and applications.

You retain ownership of any data you submit to the Service. By using the Service you grant us a limited licence to process that data to provide the Service and to improve bot detection. On the Standard plan, that includes training our global detection model. On the Pro plan, your data trains only your own model and never goes into the global one.

Your data

Our handling of personal data is described in the Privacy Policy, which forms part of these Terms. Where you are a controller and we are a processor under GDPR, we will enter into a Data Processing Addendum ("DPA") on request.

We delete the raw signals behind a session seven days after it starts, so we can't reconstruct older sessions for disputes or audits. If you need a record of a decision, store the verify response on your side.

Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Bot detection is probabilistic. We do not warrant a specific accuracy rate, that every automated session will be identified, or that no person will be challenged or get a block decision. You remain responsible for your own risk tolerance and any downstream decisions made on scoring output.

Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BOTARDO AG SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE.

OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICE IS LIMITED TO THE FEES YOU PAID TO US IN THE TWELVE MONTHS PRECEDING THE CLAIM.

Termination

You may cancel your account at any time from the console. Cancellation takes effect at the end of your current billing period.

We may suspend or terminate your account immediately for breach of these Terms or applicable law, or for convenience with 30 days' written notice. On termination, your right to use the Service ceases and we will delete your data in accordance with the Privacy Policy.

Governing law

These Terms are governed by the laws of Switzerland. Any dispute arising from or relating to these Terms shall be subject to the exclusive jurisdiction of the courts of Zurich, Switzerland, unless mandatory consumer protection law in your country of residence requires otherwise.

Changes

We may update these Terms from time to time. Material changes will be posted here with at least 14 days' notice and emailed to account admins. Continued use of the Service after the effective date constitutes acceptance of the revised Terms.
