01Acceptance
By accessing or using the Botardo website, Console, or API (collectively the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Service on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.
If you do not agree with any part of these Terms, you must stop using the Service immediately.
02The service
Botardo provides a bot-detection platform that scores form submissions in real time and exposes results through the Console dashboard and REST API. We may modify, suspend, or discontinue any part of the Service at any time with reasonable advance notice where practical.
We aim for high availability but do not guarantee uninterrupted access. Scheduled maintenance will be announced in advance where possible.
03Accounts
You must provide accurate information when creating an account. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. Notify us immediately at [email protected] if you suspect unauthorised access.
Accounts may not be shared or transferred without our prior written consent. Each seat corresponds to one named individual.
04Acceptable use
You may use the Service only for lawful purposes and in accordance with these Terms. You must not:
- Use the Service to engage in illegal activity or to process data you have no right to process.
- Attempt to probe, scan, or test the vulnerability of the Service or bypass any security measures.
- Reverse-engineer, decompile, or extract source code from any part of the Service.
- Resell or sublicense access to the Service without our written consent.
- Transmit malicious code or interfere with the integrity or performance of the Service.
- Scrape, index, or harvest data from the Console or API beyond normal programmatic use for your own forms.
We reserve the right to suspend or terminate accounts that violate these rules without prior notice.
05Payment
Paid plans are billed in advance on a monthly basis. All fees are exclusive of taxes. You are responsible for any applicable sales tax, VAT, or similar levy. Payments are processed by Stripe; we do not store card data.
Subscriptions renew automatically each month unless cancelled before the renewal date. We do not offer refunds for partial billing periods already consumed.
06Intellectual property
The Service, including all software, algorithms, scoring models, documentation, and trademarks, is owned by Botardo AG and protected by applicable intellectual property law. These Terms grant you a limited, non-exclusive, non-transferable licence to use the Service for your own forms.
You retain ownership of any data you submit to the Service. By using the Service you grant us a limited licence to process that data solely for the purpose of providing and improving the bot-detection service.
07Your data
Our handling of personal data is described in the Privacy Policy, which forms part of these Terms. Where you are a controller and we are a processor under GDPR, we will enter into a Data Processing Addendum ("DPA") on request.
08Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
Bot detection is probabilistic. We do not warrant a specific accuracy rate or that every automated submission will be identified. You remain responsible for your own risk tolerance and any downstream decisions made on scoring output.
09Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BOTARDO AG SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE.
OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICE IS LIMITED TO THE FEES YOU PAID TO US IN THE TWELVE MONTHS PRECEDING THE CLAIM.
10Termination
You may cancel your account at any time from the Console. Cancellation takes effect at the end of your current billing period.
We may suspend or terminate your account immediately for breach of these Terms or applicable law, or for convenience with 30 days' written notice. On termination, your right to use the Service ceases and we will delete your data in accordance with the Privacy Policy.
11Governing law
These Terms are governed by the laws of Switzerland. Any dispute arising from or relating to these Terms shall be subject to the exclusive jurisdiction of the courts of Zurich, Switzerland, unless mandatory consumer protection law in your country of residence requires otherwise.
12Changes
We may update these Terms from time to time. Material changes will be posted here with at least 14 days' notice and emailed to account admins. Continued use of the Service after the effective date constitutes acceptance of the revised Terms.
